If you are a California resident, you may have noticed warning labels on our products or other consumer goods referring to chemicals that may cause cancer, birth defects, or other reproductive harm.

This page explains why these warnings appear on some of our products and what they mean for you as a consumer.

What is Proposition 65?

In 1986, California voters approved the Safe Drinking Water and Toxic Enforcement Act, commonly known as Proposition 65 or Prop 65. This California state law was designed to:

• Protect California's drinking water sources from harmful chemicals
• Reduce exposures to chemicals known to cause cancer or reproductive harm
• Inform California residents about potential exposures to listed chemicals
• Enable consumers to make more informed purchasing decisions

The Prop 65 Chemical List

The State of California maintains a list of chemicals that it has reason to believe cause cancer, birth defects, or other reproductive harm. This list currently includes over 900 chemical substances, including:

• Naturally occurring substances – such as metals and minerals
• Synthetic substances – such as plastics, additives, and manufacturing byproducts

These Prop 65 listed chemicals are commonly found in everyday items such as:

• Automobiles and automotive parts
• Building materials and construction products
• Cosmetics and personal care products
• Electronics and batteries
• Foods and beverages
• Furniture and home goods
• Medicines and medical devices
• Product packaging materials
• Tools and equipment

Understanding "Safe Harbor" Levels

Prop 65 does not establish acceptable concentrations or ban the use of listed chemicals. However, the California Office of Environmental Health Hazard Assessment (OEHHA) has established "safe harbor" exposure levels for approximately one-third of the listed chemicals.

How Safe Harbor Levels Are Determined:

• For carcinogens: Based on the quantity that would result in one excess case of cancer in an exposed population of 100,000, assuming lifetime (70-year) exposure
• For reproductive toxins: Established through a similar risk assessment process
• Below safe harbor levels: Warnings are not required

Why Submersible Systems Products Have Prop 65 Warnings

California law requires businesses to provide a clear and reasonable warning before knowingly and intentionally exposing anyone to a listed chemical. This requirement applies even if:

• The chemical is present in trace amounts
• The exposure is indirect (through components or manufacturing)
• The product is safe when used as intended
• The chemical is below established safe harbor levels

Important: A Prop 65 warning does not mean that using a product will cause cancer or reproductive harm. It simply means that the product contains or may expose users to one or more chemicals on California's Prop 65 list.

Understanding Prop 65 Enforcement

Businesses that sell or deliver products in California without providing required Prop 65 warnings can face significant fines and penalties. Unfortunately, Prop 65 enforcement has a history of frivolous lawsuits and "bounty hunter" litigation.

As a result, many businesses choose to provide Prop 65 warnings as a precautionary measure, even when:

• Products do not pose a significant risk of direct exposure
• Chemical concentrations are below safe harbor levels
• Exposure is minimal or unlikely during normal use

This approach helps businesses avoid costly litigation while still complying with California law.

Are Submersible Systems Products Safe?

Yes. The products we sell are neither illegal nor unsafe. Our dive safety equipment meets or exceeds all applicable safety standards and regulations.

Prop 65 warnings are about disclosure and informed choice, not product safety. The presence of a Prop 65 warning does not mean:

• The product is unsafe or defective
• The product violates any safety standards
• You will experience health problems from using the product
• The product should not be used as intended
